Abstract:

“Tujuan dari penulisan ini adalah untuk memahami dua hal. Pertama, bagaimana pengaturan perlindungan HAM dapat diterapkan di laut, terutama di daerah laut lepas yang pada dasarnya tidak dimiliki oleh siapa pun, termasuk negara. Kedua, bagaimana kewajiban negara dapat timbul di laut lepas untuk melindungi HAM individu yang berada di kapal tersebut. Penulis menggunakan metode penelitian hukum normatif untuk menyelidiki isu-isu yang dibahas. Sebagai hasilnya, dapat disimpulkan bahwa hukum internasional mengenai perlindungan HAM dapat diterapkan, didasarkan pada Pasal 293 UNCLOS yang memperbolehkan penggunaan hukum internasional yang relevan. Selain itu, kewajiban negara di laut lepas timbul dari yurisdiksi eksklusif negara bendera yang berlaku untuk kapal tersebut. Oleh karena itu, negara bendera harus memastikan bahwa kapal tersebut mematuhi semua hukum nasional dan internasional yang berlaku, sesuai dengan yurisdiksi negara bendera. Firstly, it aims to comprehend how regulations pertaining to the protection of Human Rights can be implemented at sea, specifically in the high seas, which are essentially unclaimed territories not belonging to any state. Secondly, it seeks to explore the obligations of states in the high seas to safeguard the Human Rights of individuals aboard ships. The author will utilize a normative legal research methodology to address these concerns. Consequently, it can be inferred that international laws concerning the protection of Human Rights can be applied by invoking Article 293 of UNCLOS, which allows for the incorporation of relevant international laws. Furthermore, state obligations in the high seas emanate from the flag state’s exclusive jurisdiction over the ship. Hence, the flag state bears the responsibility to ensure that the ship adheres to all applicable national and international laws, in accordance with the flag state’s jurisdiction.
