Abstract:
“Studi ini bertujuan meninjau dan menelaah pengaturan keberlakuan wasiat olografis serta akibat hukumnya jika tidak dilakukan penitipan kepada Notaris dirujuk melalui Kitab Undang-Undang Hukum Perdata. Dalam studi ini pula mempergunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan analisis konsep hukum. Hasil studi menjelaskan pengaturan keberlakuan sepanjang mengenai wasiat olografis sebagaimana menurut KUHPerdata diatur dalam Pasal 931 hingga Pasal 937 KUHPerdata dengan pengaturan formalitas syarat keberlakuannya hingga Pasal 953 KUHPerdata. Di samping itu, wasiat olografis yang tidak dititipkan kepada Notaris akan memiliki ancaman kebatalan sebagaimana dirumuskan dalam Pasal 953 KUHPerdata. Para pihak yang berkepentingan dan merasa dirugikan haknya atas tindakan pewasiat yang tidak menitipkan wasiat olografisnya kepada Notaris harus mengajukan gugatan kepada Pengadilan untuk memutuskan wasiat tersebut tidak mempunyai kekuatan eksekusi dan harus dibatalkan. Wasiat olografis yang ternyata tidak dilakukan penitipan kepada Notaris harus dinyatakan melanggar formalitas yang telah ditentukan oleh undang-undang sehingga wasiat olografis tersebut tidak mempunyai kekuatan eksekutorial dan memuat ancaman kebatalan yang harus dibuktikan terlebih dahulu di Pengadilan oleh pihak yang berkepentingan. Kata Kunci: KUHPerdata, Notaris, Penitipan, Wasiat Olografis ABSTRACT This study aims to review and analyze the regulation of the validity of an olographic testament and the legal consequences of not being deposited to a Notary if viewed from the Civil Code. The application of the method in this study uses a normative legal research with an approach form the aspect of the statute and legal concept analysis. The results of the study show that the regulation of validity as long as the olographic testament according to the Civil Code is regulated in Article 931 to Article 937 of the Civil Code with the formality setting conditions for its validity up to Article 953 of the Civil Code. While, an olographic testament that is not deposited to a Notary testament have a threat of cancellation as formulated in Article 953 of the Civil Code. Interested parties who feel that their rights have been harmed for testator actions that do not deposite their olographic testament to the Notary must file a lawsuit to the Court to decide that the testament does not have the power of execution and must be canceled. In this way, an olographic testament which is apparently not being deposited to a Notary should be declared to have violated the formalities determined by law so that the olographic testament does not have executive power and carries the threat of cancellation that must be proven in advance in court by the interested parties.
