Abstract:

“Tujuan penulisan ini yakni untuk mengetahui dasar ketentuan dalam pengaturan hukum dari tanggungjawab produk dalam cacat produksi airbag pada kendaraan roda empat dan upaya sarana penyelesaian hukumnya bagi konsumen yang mendapati kerugian akibat produk tersebut. Studi ini mempergunakan metode penelitian yang berbentuk hukum normatif, yakni suatu penelitian yang menggunakan studi kepustakaan (Library Research) sebagai dasar. Dengan mempergunakan pendekatan perundang-undangan (statue approach) yakni mempelajari buku-buku literatur dan pendekatan fakta (the fact approach). Hasil studi menunjukkan bahwa Undang-Undang Nomor 8 Tahun 1999 digunakan sebagai pedoman guna melindungi hak-hak dari konsumen serta dapat memahami upaya penyelesaian sengketa serta pertanggungjawaban kepada produsen terkait cacat produksi pada airbag kendaraan roda empat. This study uses a research method in the form of normative law, namely a study that uses library research as the basis and approach to legislation and studies literature books and the fact approach. The results of the study show that Law Number 8 of 1999 is used as a guideline to protect the rights of consumers and to understand dispute resolution efforts and accountability to producers regarding production defects in four-wheeled vehicle airbags.
