Abstract:

“Penulisan artikel ini memiliki dua tujuan, Pertama mengetahui kesesuaian antara Pasal 359 ayat (2) Undang-Undang No. 1 Tahun 2009 tentang Penerbangan (UU Penerbangan) dengan hak asasi manusia yang termuat dalam konstitusi. Kedua, menganalisis konstruksi norma yang tepat dalam membatasi informasi hasil investigasi kecelakaan pesawat di Indonesia untuk masa mendatang (ius constituendum). Penelitian dalam artikel ini menggunakan metode hukum normatif dengan pendekatan undang-undang, pendekatan konsep, dan pendekatan kasus. Hasil penelitian menunjukkan bahwa Pasal 359 ayat (2) UU Penerbangan bertentangan dengan konstitusi (inkonstitusional). Hal tersebut didasari oleh tiga hal. Pertama, adanya norma baru dalam penjelasan pasalnya sehingga menimbulkan banyak penafsiran. Kedua, Pasal a quo tidak memuat batasan waktu untuk merahasiakan suatu infromasi yang merupakan hak asasi manusia. Ketiga, berdasarkan tahap uji proporsionalitas, Pasal a quo tidak memenuhi persyaratan dalam Tahap Kesesuaian karena pembatasan yang dilakukan oleh negara tidak memenuhi Pasal 28J UUD NRI 1945, Pasal 17 UU Keterbukaan Informasi Publik, dan Prinsip Siracusa. Pasal 359 ayat (2) UU Penerbangan tidak memenuhi asas kepastian hukum yang adil jika norma a quo tidak mengalami perubahan. Penggunaan moda transportasi pesawat udara dalam meningkatkan laju perekonomian, sosial budaya, politik, dan pertahanan keamanan oleh masyarakat menjadikan Pasal 359 ayat (2) UU Penerbangan sangat penting untuk diperbaharui. Sudah menjadi tanggung jawab pemerintah untuk menjamin pegakkan hak asasi manusia. Hak atas informasi (right to information) merupakan hak dasar yang pemenuhannya harus dijamin oleh negara melalui kepastian hukum yang adil. Second, analyzing the appropriate construction norms to limiting information on the results of aircraft accident investigations in Indonesia. The research in this paper uses the normative legal method with a law approach, a concept approach, and a case approach. The results of the study show that Article 359 paragraph (2) of Aviation Law is contrary to constitution (unconstitutional). This is based on three things. First, there is a new norm in the explanation of the article. Second, article a quo doesn’t contain a time to limiting the information which is a human right. Third, based on the proportionality test, Article a quo doesn’t appropriate the requirements of Conformity Stage because the restrictions imposed by the state, don’t appropriate the Article 28J of the UUD 1945, Article 17 of Undang-Undang No. 14 Tahun 2008 (Public Information Openness Law), and the Siracusa Principle. Article 359 paragraph (2) of the Aviation Law doesn’t fulfill the principle of fair legal certainty if the norm doesn’t change. Aircraft transportation modes increasing the pace of the economy, socio-culture, politics, and security-defense, that is makes Article 359 paragraph (2) of Aviation Law very important to updated. It is the government’s responsibility to ensure the enforcement of human rights. Right to information is a basic right whose fulfillment must be guaranteed by the state through fair legal certainty.
