Abstract:

“Tujuan dari studi ini untuk mengetahui dan menganalisis tentang status hutan adat setelah keluarnya Putusan MK Nomor 35/2012 dan implikasi putusan tersebut terhadap hutan adat dan eksistensi masyarakat hukum adat. Studi ini menggunakan metode penelitian normatif dengan pendekatan perundang-undangan (statute approach) dan pendekatan konseptual (conceptual approach). Berdasarkan hasil penelitian ini diketahui bahwa Putusan MK Nomor 35/2012 telah mengubah status hutan adat dari utan negara menjadi hutan hak dan mengkehendaki bahwa hutan adat haruslah dipahami sebagai hutan yang berada di kawasan MHA. UU Kehutanan yang memasukan hutan adat kedalam status hutan negara dianggap telah menggerus hak masyarakat hukum adat atas hutan adat yang merupakan bagian dari tanah ulayatnya. Dibentuknya beberapa peraturan-peraturan yang mengatur tentang hutan adat yang salah satunya Keputusan Menteri Lingkungan Hidup dan Kehutanan Nomor SK. 312/MENLHK/SETJEN/PSKL.1/4/2019 tentang Peta Hutan Adat dan Wilayah Indikatif Hutan Adat dan pembentukan peraturan daerah yang mengatur tentang pengukuhan dan hapusnya MHA sebagai Implikasi dari keluarnya Putusan Mahkamah Konstitusi memberikan kepastian atas wilayah hutan adat dan keberadaan MHA. ABSTRACT The purpose of this study is to find out and analyze the status of customary forests after the issuance of the Constitutional Court Decision Number 35/2012 and the implications of this decision on customary forests and the existence of indigenous peoples. This study uses a normative research method with a statutory approach (statute approach) and a conceptual approach (conceptual approach). Based on the results of this study, it is known that the Constitutional Court Decision Number 35/2012 has changed the status of customary forests from state-owned orangutans to private forests and requires that customary forests must be understood as a forest within the territory of indigenous people. The Forestry Law, which enters customary forest into state forest status, is deemed to have eroded the rights of indigenous people to customary forests which are part of their customary land. The formation of several regulations governing customary forests, one of which is the Decree of the Minister of Environment and Forestry Number SK. 312 / MENLHK / SETJEN / PSKL.1 / 4/2019 concerning Maps of Customary Forests and Indigenous Areas of Indigenous Forests and the establishment of regional regulations governing the inauguration and removal of MHA as an implication of the issuance of the Constitutional Court Decision to provide certainty over customary forest areas and the existence of indigenous people.
