Abstract:

“Perlunya penulisan jurnal ini diangkat bertujuan untuk menganalisis dan memahami perlindungan hukum terhadap konsumen yang dirugikan dan mengetahui pertanggung jawaban dari pihak pelaku usaha online tersebut. Metode penelitian yang digunakan dalam penulisan ini yaitu metode penelitian normatif. Adanya Undang-Undang No. 8 Tahun 1999 tentang perlindungan konsumen bagi konsumen yang dirugikan oleh pelaku usaha atas kelalaian yang dilakukan melalui akun usaha online dapat memperoleh perlindungan dari kecurangan pelaku usaha. Pelaku usaha yang melakukan wanprestasi dengan menggunakan akun tanpa adanya informasi yang jelas dapat dikenakan Undang-Undang No. 19 Tahun 2016 tentang perubahan atas Undang-Undang No.11 Tahun 2008 tentang Informasi dan Transaksi Elektronik (UU ITE). Agar konsumen dapat merasakan hak-haknya sebagai konsumen maka diperlukannya kepastian hukum yang bertujuan agar terciptanya keamanan dan kenyamanan masyarakat dalam berbelanja online. ABSTRACT The necessity for writing this journal is aimed at analyzing and understanding legal protection for consumers who are disadvantaged and to find out the responsibilities of these online business actors. The research method used in this paper is normative research method. The existence of Law No. 8 of 1999 concerning consumer protection for consumers who are harmed by business actors for negligence made through online business accounts can obtain protection from business actor fraud. Business actors who commit default by using an account without clear information are subject to law No. 19 of 2016 concerning amendments to Law No. 11 of 2008 concerning Information and Electronic Transactions (UU ITE). In order for consumers to feel their rights as consumers, legal certainty is needed which aims to create security and comfort for the community in online accommodation.
