Kewenangan Peradilan Tata Usaha Negara Terhadap Pegawai Negeri Sipil Yang Diberhentikan Secara Tidak Hormat

Abstract:
“Penulisan Jurnal ini bertujuan menjawab bagaimana upaya hukum serta prosedur dalam sistem Peradilan Tata Usaha Negara terhadap Pegawai negeri sipil yang merasa tak diuntungkan atas sanksi disiplin yang dilayangkan terhadapnya akibat tergabung dalam suatu partai politik berupa pemberhentian secara tidak hormat atau pencabutan atas jabatan melalui surat keputusan yang dilayangkan oleh pejabat yang berwenang menghukum didalam sebuah sengketa Tata Usaha Negara. Serta dalam metodenya menggunakan metode normatif serta melakukan pendekatan melalui peraturan-perundang-undangan yang berlaku dan mengacu pada studi kasus terkait problematika sengketa dalam ranah peradilan tata usaha negara. Upaya Hukum yang dapat diajukan oleh Pegawai Negeri Sipil yang diberhentikan secara tidak hormat dengan alasan tindakan pelanggaran Disiplin Pegawai yakni melalui tiga Jalur yaitu Upaya Keberatan Administratif , Banding Administratif, dan Pengajuan Gugatan ke Pengadilan Tata Usaha Negara. Namun upaya administratif haruslah didahulukan dikarenakan Pengadilan barulah memiliki wewenang untuk melakukan pemeriksa, memberikan putusan, dan menyelesaikan sengketa Tata Usaha Negara apabila keseluruhan upaya administratif telah dilaksanakan. Kata Kunci: Upaya Hukum, Pegawai Negeri Sipil, Sengketa Tata Usaha Negara, Pencabutan Jabatan ABSTRACT This journal aims to answer how legal efforts and procedures in the State Administrative Court system against civil servants who feel disadvantaged by the disciplinary sanctions imposed on them due to joining a political party in the form of dishonorable dismissal or revocation of their position through a decree sent by an official in charge of punishing in a State Administration dispute. As well as in the method using the normative method and taking a statute approach and case approavh which related to the problem of disputes in the realm of state administrative courts. Legal remedies that can be filed by civil servants who are dishonorably discharged on the grounds of violations of employee discipline, namely through three channels, namely remedies of administrative objections, administrative appeals, and make a legal action to the State Administrative Court. However, administrative efforts must take precedence because the Court only has the authority to conduct examinations, give decisions, and resolve State Administrative disputes when all administrative efforts have been carried out.
