IMPLIKASI BUDAYA PATRIARKI TERHADAP PEREMPUAN SEBAGAI TUKANG SUUN DI PASAR BADUNG DALAM PERSPEKTIF HUKUM ADAT

Abstract:

“Penelitian ini bertujuan untuk memahami dan mengkaji terkait dampak dari adanya budaya patriarki dalam perspektif hukum adat yang menyebabkan ketidakadilan, kedudukan, serta peran ganda yang dimiliki oleh perempuan Bali. Peran ganda difokuskan kepada perempuan berprofesi sebagai tukang suun di pasar Badung. Hal itu karena umumnya perempuan berpendidikan rendah sehingga pekerjaannya masih kelas bawah. Metode penelitian yang digunakan dalam penulisan ini yaitu metode penelitian empiris yang mana menggunakan data primer dan data sekunder dengan teknik pengumpulan data melalui wawancara. Hasil wawancara menunjukkan bahwa, dari segi regulasi sudah terdapat aturan kesetaraan gender baik dari hukum adat, hukum nasional, dan hukum Internasional. Perempuan yang bekerja sebagai tukang suun di pasar Badung yang memiliki peran ganda tentu tidak mengesampingkan salah satu tugasnya. Perempuan yang bekerja di sektor publik telah memilih sendiri jalan mereka untuk dapat membantu suami mencari nafkah. UU No.1 Tahun 1974 tentang Perkawinan sudah jelas dituangkan terkait kedudukan dan hak antara perempuan dan laki-laki, tetapi umumnya dampak dari budaya patriarki hukum adat masih dirasakan oleh perempuan. Namun, budaya sistem keturunan patrilineal dalam perspektif hukum adat Bali tidak perlu diadakan perubahan walaupun hakikatnya hukum adat bersifat dinamis mengikuti kebutuhan masyarakat adat. Perilaku masyarakat adat dalam hal paradigmanya terkait sistem patriarki yang perlu diperbaiki. Kata Kunci: Peran Ganda Perempuan, Budaya Patriarki, Hukum Adat ABSTRACT The purpose of this research is to understand and examine the impact of patriarchal culture in the perspective of customary law that causes injustice in position and dual roles that balinese women have. This dual role will be focused on women who work as “tukang suun” at badung market. This is because generally women have low education so that their jobs are still in the lower class. The research method used in this paper is an empirical research method which uses primary and secondary data and also collects data through interviews. Based on the results of the interviews, it shows that if viewed from a regulatory perspective, there are existing gender equality rules from customary law, national law, and international law. Women who work as “tukang suun” at badung market, who have multiple roles certainly don’t neglect one of their duties. Women who work in the public sector have chosen their own way to be able to help their husbands earn money. Law number 1 of 1974 concerning Marriage has clearly stated the position and rights between women and men, but generally the impact of the patriarchal culture of customary law is still felt by women. However, the culture of the patrilineal system in the perspective of balinese customary law doesn’t need to be changed even though customary law is changing dynamically according to their needs. The behavior of indigenous peoples in terms of their paradigm is related to the patriarchal system that still needs to be corrected. Key Words: Dual Roles Women, Patriarchal Culture, Customary Law.”
