Abstract:

“Penelitian yang dilakukan ini tujuannya adalah untuk melakukan pengkajian atas penggunaan cryptocurrency dalam tindak pidana pencucian uang yang mana merupakan bagian dari kejahatan siber berkonteks pencucian uang. Guna mendukung proses pengakajian, digunakan metode penelitian hukum normative yang dibarengi dengan pendekatan secara konseptual dan peraturan perundangundangan. Sehingga hasil yang didapat adalah kemunculan cryptocurrency yang diresahkan akan memberikan peluang baru terhadap tindak pidana pencucian yang belum diatur secara khusus. Pembaruan pengaturan atas tindak pidana pencucian uang layaknya diperbaharui dengan beredarnya penggunaan cryptocurrency dari peraturan sebelumnya Sehingga dalam perumusan peraturan perlu melakukan perbandingan dengan pengaturan di beberapa negara. The purpose of this research is to conduct an assessment of the use of cryptocurrencies in money laundering crimes which are part of cyber crimes in the context of money laundering. In order to support the assessment process, normative legal research methods are used coupled with a conceptual approach and statutory regulations. So the result obtained is that the emergence of cryptocurrency which is worried will provide new opportunities for laundering crimes that have not been specifically regulated. Renewal of the regulation on money laundering is like being updated with the circulation of the use of cryptocurrency from the previous regulation, namely law number 8 of 2010 concerning the prevention and eradication of money laundering. So that in the formulation of regulations it is necessary to make comparisons with regulations in several countries.”
