Abstract:
“ABSTRAK Tujuan dari tulisan ini adalah untuk menambah wawasan mengenai prinsip tanggung jawab negara pada wilayah perwakilan konsuler yang dimana dalam suatu perwakilan konsuler terdapat yurisdiksi lebih darisatu negara yang dimana yurisdiksi tersebut terdiri dari yurisdiksi negara pengirim serta negara penerima. Dalam penelitian jurnal ini menggunakan salah satu jenis penelitian yaitu penelitian hukum normatif yang mengkaji perUU dan bahan literatur yang berkaitan dengan pokok bahasan Hasil studi ini menunjukkan bahwa : pertama, dalam suatu perwakilan konsuler pada suatu negara terdapat lebih dari satu yurisdiksi yang berlaku serta bentuk pertanggung jawaban dari negara juga sudah diatur dalam Draft Articles on the Responsibility of States for Internationally Wrongful Acts Kedua,dalam hal terjadi pembunuhan dalam perwakilan konsuler yurisdiksi yang digunakan untuk mengadili tidak hanya terbatas pada yurisdiksi negara pengirim saja melainkan yurisdiksi negara penerima dapat di terapkan. Kata Kunci : Yurisdiksi,Tanggung Jawab Negara, Konsuler ABSTRACT The purpose of this paper is to add insight into the principle of state responsibility in the consular area where in a consular representative there is more jurisdiction than one country where the jurisdiction consists of the jurisdiction of the sending country and the receiving country. In this journal research uses one type of research, namely normative legal research which examines the law and literature related to the subject matter.The results of this study show that: first, in a consular representative in a country there is more than one jurisdiction that applies and forms of accountability from the state has also been regulated in the Second Draft Articles on the Responsibility of States for Internationally Wrongful Acts, in the event of a murder in the consular representative the jurisdiction used to judge is not only limited to the jurisdiction of the sending country but the jurisdiction of the recipient country can be applied.
