Abstract:

“Tujuan penulisan ini adalah perlindungan hukum dan tanggung jawab terhadap masyarakat dalam rangka pelaksanaan vaksinasi covid-19. Metode penelitian penulisan jurnal ini menggunakan metode penelitian hukum normatif jenis penelitian yang sering digunakan dalam mengkaji suatu norma dalam peraturan perundang-undangan yang sudah dirumuskan secara jelas dan tidak multitafsir, apakah terdapat pertentangan norma, atau apakah suatu peraturan perundang-undangan tidak mengatur suatu perbuatan hukum yang seharusnya diatur diatur terlebih dahulu. Hasil penelitian jurnal ini menjelaskan bahwa Perlindungan hukum terhadap masyakat penerima vaksinasi covid-19 diatur yakni dengan diterbitnya peraturan Presiden Republik Indonesia Nomor 99 Tahun 2020 tentang Pengadaan Vaksin dan Pelaksanaan Vaksinasi Dalam Rangka Penanggulangan Pandemi Corona Virus Disease 2019 (covid-19) sebagaimana telah diubah dengan Peraturan Presiden Republik Indonesia Nomor 14 Tahun 2021 tentang Perubahan atas Peraturan Presiden Republik Indonesia Nomor 99 Tahun 2020 tentang Pengadaan Vaksin dan Pelaksanaan Vaksinasi Dalam Rangka Penanggulangan Pandemi Corona Virus Disease2019 (covid-19), dalam produk hukum perpres ini juga diatur tentang tanggung jawab pemerintah apabila terjadinya kejadian ikutan pasca Vaksinasi covid-l9, yang akan dilakukan pengobatan dan perawatan sesuai dengan indikasi medis dan protokol pengobatan. Apabila kasus lanjutan tersebut menimbulkan kecacatan atau meninggal, diberikan kompensasi oleh pemerintah. Upaya penyelesaian sengketa terhadap pelaksanaan vaksinasi covid-19 dapat dilakukan secara jalur litigasi dan non litigasi. The purpose of this paper is legal protection and responsibility for the community in the context of implementing the covid-19 vaccination. The research method for writing this journal uses normative legal research methods, the type of research that is often used in reviewing a norm in legislation that has been clearly formulated and does not have multiple interpretations, whether there is a conflict of norms, or whether a statutory regulation does not regulate a legal act. which should be set first. The results of this journal research explain that legal protection for the community receiving the COVID-19 vaccination is regulated by the issuance of the Presidential Regulation of the Republic of Indonesia Number 99 of 2020 concerning Vaccine Procurement and Vaccination Implementation in the Context of Combating the 2019 Corona Virus Disease Pandemic (covid-19) as amended by Presidential Regulation of the Republic of Indonesia Number 14 of 2021 concerning Amendments to Presidential Regulation of the Republic of Indonesia Number 99 of 2020 concerning Procurement of Vaccines and Implementation of Vaccinations in the Context of Combating the Corona Virus Disease 2019 (Covid-19) Pandemic. the occurrence of follow-up events after the covid-19 vaccination, which will be treated and treated according to medical indications and treatment protocols. If the follow-up case causes disability or death, compensation is given by the government. Efforts to resolve disputes regarding the implementation of COVID-19 vaccination can be carried out through litigation and non-litigation.”
