Abstract:

“Tujuan dilakukan penelitian ini untuk mengetahui faktor-faktor penyebab terjadinya pelanggaran hukum (rangkap jabatan) dan untuk mengetahui proses penyelesaian perakara rangkap jabatan. Studi ini menggunakan metode penelitian empiris dengan menggunakan jenis pendekatan perundang-undangan (The Statute Approach) dan pendekatan fakta (The Fact Approach). Hasil studi menunjukkan bahwa faktor-faktor yang menyebabkan terjadinya pelanggaran yaitu ekonomi, moral, kepentingan dan kesempatan, dengan faktor ekonomi menjadi faktor utama seseorang melanggar hukum. Penyelesaian pelanggaran rangkap jabatan dapat dilakukan dengan dua mekanisme yaitu: 1. Pengunduran diri atau 2. Pemberhentian.
