Abstract:

“Pelanggaran ataupun perenggutan atas hak asasi manusia khususnya pelanggaran hak asasi perempuan masih terjadi walaupun hukum internasional sudah mengatur dengan sedemikian rupa aturan untuk melindungi Hak Asasi Manusia setiap manusia di dunia. Tulisan ini bertujuan untuk membahas mengenai pengaruh yang timbul setelah dilakukannya penarikan Pasukan Amerika Serikat di Afghanistan kepada hak perempuan di Afghanistan dilihat dari perspektif Hukum Internasional. Artikel ini menggunakan metode penelitian yang menggabungkan metode penelitian normatif empiris. Hasil penelitian ini menunjukkan bahwa penarikan pasukan Amerika dari Afghanistan memberikan dampak buruk kepada hak-hak perempuan disana dikarenakan Taliban kembali mengambil alih pemerintahan. Untuk mengatasi permasalahan mengenai pelanggaran hak asasi perempuan terlebih dalam penyelesaian isu terorisme di Afghanistan, diberlakukanlah CEDAW sebagai implementasi dari Hukum Humaniter yang didasarkan kepada Keputusan Presiden yang bertujuan untuk melawan diskriminasi terhadap perempuan. Kata Kunci : Pelanggaran Hak Perempuan, Humaniter, Terorisme, Diskriminasi, Hukum Internasional. ABSTRACT Violations or deprivation of human rights, especially violations of women’s rights still occur even though international law has regulated in such a way the rules to protect the human rights of every human being in the world. This paper aims to discuss the effects that emerged after the withdrawal of the United States Troops in Afghanistan on women’s rights in Afghanistan from the perspective of International Law. This article uses a research method that combines empirical normative research methods. The results of this study indicate that the withdrawal of American troops from Afghanistan had a negative impact on women’s rights there because the Taliban took over the government again. To overcome the problem of women’s human rights violations, especially in resolving the issue of terrorism in Afghanistan, CEDAW was enacted as the implementation of Humanitarian Law based on a Presidential Decree which aims to fight discrimination against women.
