Abstract:

“Studi ini bertujuan untuk mengetahui pertanggungjawaban dari perusahaan maskapai penerbangan terhadap korban yang dirugikan karena terjadinya kecelakaan pesawat. Adapun kajian studi ini termasuk ke dalam penelitian kajian hukum normatif dengan menggunakan pendekatan yaitu statute approach. Hasil kajian penelitian ini menunjukan adanya keterkaitan antara hukum dan juga pertanggungjawaban dari perusahaan maskapai penerbangan terhadap korban sebagai pihak yang dirugikan akibat kecelakaan pesawat yang telah diatur dalam Peraturan Menteri Perhubungan No. 77 Tahun 2011 tentang Tanggung Jawab Pengangkut Angkutan Udara (Permenhub 77/2011). This study aims to determine the liability of airline companies to the victims who are harmed due to plane crashes. This study is comprised as a normative legal research implementing the statute approach method. Results of this study shows the legal relationship between and also the airline company’s responsibility to the victim as the party who was harmed due to the plane crash in accordance with the Regulation of the Minister of Transportation No. 77 of 2011 concerning Responsibilities of Air Transport Carriers (Permenhub 77/2011).”
