Abstract:

“Dalam penelitian ini dikaji mengenai konsep batas usia dewasa menurut hukum positif di Indonesia serta mengenai waktu kecakapan seseorang untuk bertindak sebagai pemberi wasiat dalam perspektif pluralisme hukum di indonesia. Metode penelitian yang digunakan yakni normatif melalui pendekatan undang-undang dan pendekatan konseptual, Dalam penelitian ini didapat hasil penelitian yakni ditemukan adanya ketentuan batasan usia dewasa yang berbeda dalam peraturan perundang-undangan yang ada. Adapun seseorang dapat dinilai cakap menurut hukum untuk bertindak sebagai pemberi wasiat ketika dirinya telah mencapai usia 18 tahun. Mengenai konsep batas usia dewasa menurut hukum positif di Indonesia jika ditinjau dari Hukum Adat Bali dan KUHP Hukum Perdata memiliki persepsi berbeda-beda. Dalam hukum adat Bali tidak dikenal batas usia dewasa tertentu. Solusi dari adanya keberagaman batas usia dewasa ini yakni dengan dikeluarkannya Surat Edaran Mahkamah Agung Nomor 07 Tahun 2012 guna mewujudkan unifikasi hukum agar tidak terjadi penafsiran yang berbeda dalam menentukan usia kecakapan seseorang. Kata Kunci: Batasan Usia, Kedewasaan dan Kecakapan, Pewasiatan, hukum ABSTRACT This study examines the concept of the adult age limit according to positive law in Indonesia and about the time of a person’s ability to act as a testator in the perspective of legal pluralism in Indonesia. The research method used is normative through a statute approach and a conceptual approach. A person can be judged as capable according to law to act as a testator when he reaches the age of 18 years. Regarding the concept of the adult age limit according to positive law in Indonesia, when viewed from the Balinese Customary Law and the Civil Code, there are different perceptions. In Balinese customary law, there is no specific adult age limit. The solution to the diversity of age limits today is the issuance of Circular Letter of the Supreme Court Number 07 of 2012 in order to realize legal unification so that there will be no different interpretations in determining a person’s age of competence.
