Abstract:

“Penulisan daripada jurnal ini yakni bermaksud mempelajari arti penting dilakukannya pendaftaran merek sebagai Perlindungan Hukum pada UMKM dan mengetahui akibat hukum yang timbul apabila merek UMKM tersebut tidak didaftarkan. UMKM merupakan bisnis profitable milik atau dijalankan oleh perseorangan(individu), rumah tangga, ataupun badan usaha yang sudah lolos standard selaku usaha mikro, UMKM berkedudukan signifikan bagi ekonomi Negara khususnya Negara Indonesia dimana UMKM sebagai tulang punggung untuk menopang ekonomi Negara saat terjadi krisis global. Metode penulisan jurnal ini menggunakan metode penelitian hukum normatif yang dikerjakan melalui mendalami bahan pustaka dan undang-undang yang berkaitan dengan penulisan ini. Hasil penulisan ini menyakatakan bahwa arti penting dilakukannya pendaftaran merek bagi UMKM yaitu untuk memperoleh perlindungan hukum supaya tidak dipakai pihak yang tidak bertanggung jawab secara melawan hukum semacam pembajakan atau penjiplakan produk yang bisa merugikan pemegang hak atas merek itu sendiri. Apabila merek sudah di daftarkan terlebih dahulu maka merek tersebut akan memperoleh Proteksi Hukum. Di Indonesia memeluk Sistem Konstitutif (first to file) artinya pihak pertama kali yang melangsungkan registrasi Merek diberikan pengutamaan guna memperoleh registrasi Merek serta dinyatakan Pemegang Resmi Merek. Adapun syarat wajib dipenuhi supaya Merek bisa di daftarkan adalah bahwa merek tersebut harus memiliki daya pembeda. Dan akibat hukum yang muncul bila merek belum atau tidak dicatatkan sehingga Merek tertera tak memperoleh perlindungan hukum atas Negara. Kata Kunci: Perlindungan Hukum, Merek, Usaha Mikro Kecil dan Menengah. ABSTRACT The writing of this journal is intended to study the importance of registering a trademark as legal protection for SMEs and knowing the legal consequences that arise if the UMKM trademark is not registered. MSMEs are profitable businesses owned or run by individuals (individuals), households, or business entities that have passed the standard as micro-enterprises. MSMEs have a significant position for the country’s economy, especially the Indonesian state, where MSMEs are the backbone to support the country’s economy during the global crisis. The method of writing this journal uses a normative legal research method which is carried out through studying library materials and laws related to this writing. The results of this paper state that the importance of trademark registration for SMEs is to obtain legal protection so that it is not used by irresponsible parties against the law such as piracy or product plagiarism that can harm the right holder of the mark itself. If the mark has been registered in advance, the mark will get legal protection. In Indonesia, adopting a Constitutive System (first to file) which means that the first party to register a Mark is given priority to obtain a Mark registration and is declared an Official Mark Holder. The conditions that must be met in order for a mark to be registered are that the mark must have distinguishing power. And the legal consequences that arise if the mark has not been or is not registered so that the listed mark does not get legal protection over the state.
