Abstract:

“Kajian ini bertujuan untuk mengetahui tentang pengaturan upah minimum bagi pekerja berdasarkan peraturan dibidang ketenagakerjaan serta upaya hukum pekerja terhadap adanya pemberian upah oleh pengusaha dibawah upah minimum. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan menggunakan pendekatan perundangan serta pendekatan konsep. Hasil penelitian ini menunjukan bahwa pengaturan tentang upah minimum telah diatur dalam Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan, namun masih banyak pekerja yang upahnya dibayarkan dibawah upah minimum, pekerja yang hak atas upahnya tida terpenuhi dapat melakukan upaya hukum dengan mediasi atau sengketa kepada pihak pengusaha sesuai dengan tata acara penyelesaian perselisihan hak yang terdapat pada undang-undang No. 2 Tahun 2004 tentang Penyelesaian Perselisihan Hubungan Industrial. Kata Kunci: Upah Minimum, Pekerja, pengusaha, penyelesaian. ABSTRACT The aim of this study is to find out about the regulation of minimum wages for workers based on regulations in the field of manpower and workers legal remedies against the existence of wages by employers below the minimum wage. The research method used is normative legal research with a statutory approach and a concept approach. The results of this study indicate that the regulation of minimum wages is regulated in Law no. 13 of 2003 concerning employment, but there are still many workers whose wages are paid below the minimum wage, if their wage rights are not fulfilled then workers can take legal action by mediation or dispute to the employer in accordance with the procedure for resolving rights disputes as regulated in Law Number 2 of 2004 concerning Settlement of Industrial Relations Disputes.”
