Abstract:

“Penelitian mengenai perlindungan konsumen masker wajah organik tanpa izin edar BPOM ini dilakukan memiliki tujuan untuk mengetahui sejauh mana hukum melindungi hak-hak yang dimiliki oleh konsumen produk perawatan wajah yang produknya tidak terdaftar di BPOM dan juga untuk mengetahui apa sanksi yang akan di dapatkan oleh pelaku usaha yang menjual masker wajah organic yang tidak memiliki izin edar. Penelitian kali ini menggunakan metode normatif yakni penelitian yang mengacu pada peraturan perundang-undangan dengan pendekatan mengacu pada UU No.8 Tahun 1999 tentang Perlindungan Konsumen dan Peraturan Presiden No. 80 Tahun 2017 Tentang BPOM. Maraknya peredaran produk masker wajah tanpa izin edar dari BPOM yang diperdagangkan secara online saat ini memperlihatkan bahwa banyak produk yang dapat di perjual belikan secara online tanpa memperhatikan kelayakan dari suatu produk. Problematika yang timbul yaitu pada saat jual beli online berlangsun ,yang mana konsumen produk masker wajah tidak dapat langsung melihat barang yang dibelinya sehingga konsumen tidak dapat memilah serta memilih apakah produk tersebut layak digunakan. Ketidak jelasan informasi pada produk masker wajah tanpa izin edar BPOM, yakni dari segi komposisi dan bahan mengakibatkan pemikiran apakah produk masker wajah tanpa izin edar BPOM ini layak di perjual belikan atau tidak. Setelah dilakukannya penelitian dapat dilihat bahwa perlindungan hukum bagi konsumen yang dirugikan karena masker wajah organic tanpa izin edar dan sanksi bagi pelaku usaha yang melakukannya telah diatur secara jelas dalam UUPK dan Peraturan Presiden tentang BPOM. Namun dikarenakan masker wajah organik banyak diperjual belikan secara online sehingga BPOM sulit untuk melakukan pengawasan. This research uses normative method, namely research that refers to legislation with an approach referring to Law No.8 of 1999 on Consumer Protection and Presidential Regulation No. 80 of 2017 on BPOM. The increasing circulation of face mask products without circulation permission from BPOM that is traded online today shows that many products can be sold online regardless of the feasibility of a product. The problem that arises is when buying and selling online berlangsun, where consumers face mask products can not directly see the goods they buy so consumers can not sort out and choose whether the product is worth using. The uncertainty of information on face mask products without bpom circulation permission, namely in terms of composition and materials resulted in the thought of whether the face mask product without bpom circulation permit is worth selling or not. After the research, it can be seen that legal protection for consumers who are harmed by organic face masks without circulation permits and sanctions for businesses that do so has been clearly regulated in the UUPK and Presidential Regulation on BPOM. However, because organic face masks are widely traded online, BPOM is difficult to supervise. Keywords : Protection, Consumens, Facial Care , Organic, Marketing Authorixation.”
