Abstract:
“Tujuan studi ini ialah memberikan pemahaman kepada masyarakat terkait pengaturan hukum dalam penyelenggaraan transportasi online di Indonesia dan untuk memberikan pengetahuan kepada masyarakat khususnya penyedia aplikasi jasa transportasi online, driver dan pengguna jasa terkait pertanggungjawaban perusahaan penyedia aplikasi transportasi online atas kerugian yang diderita pengguna jasa akibat ketidaksesuaian data aplikasi driver dan kendaraan yang dipesan. Penelitian hukum normatif ini menelaah permasalahan norma berupa kekaburan norma. Penelitian ini memuat tiga sumber hukum bahan hukum primer, sekunder dan tersier. Pendekatan dalam penelitian dilakukan melalui pendekatan konseptual. Teknik studi dokumen digunakan teknik pengumpulan bahan hukum. Kemudian terkait proses analisis atas permasalahan hukum akan dilakukan dengan logika deduktif. Hasil penelitian menunjukan bahwa penyelenggaraan transportasi online diatur melalui UU Lalu Lintas dan Angkutan Jalan dan Peraturan Mentri Perhubungan No. 118 Tahun 2018 sebagai suatu penyelenggaraan angkutan sewa khusus. Kemudian berkaitan dengan permasalahan ketidaksesuaian antara data pada aplikasi transportasi online yang memuat identitas driver dan kendaraan yang digunakan dengan identitas driver dan kendaraan yang datang seusai dipesan oleh konsumen, merupakan tanggungjawab dari perusahaan transportasi online selaku penyedia aplikasi jasa transportasi online dalam menyelenggarakan sistem elektronik. ABSTRACT The purpose of this study is to provide understanding to the public regarding legal arrangements in the implementation of online transportation in Indonesia and to provide knowledge to the public, especially online transportation service application providers, drivers and service users related to the accountability of online transportation application providers for losses suffered by service users due to incompatibility of driver and vehicle application data ordered. This normative legal research examines the problem of norms in the form of blurring norms in the regulation of accountability of online transportation application providers for losses suffered by consumers from the discrepancy of driver order application data. This study contains three legal sources of primary, secondary and tertiary legal materials. The approach in research is done through conceptual approach. Document study techniques are used legal material collection techniques. Then related to the process of analysis of legal problems will be done with deductive logic. The results showed that the implementation of online transportation is regulated through the Traffic and Road Transport Law and the Minister of Transportation Regulation No. 118 of 2018 as a special rental transportation. Then related to the problem of discrepancies between data on online transportation applications that contain the identity of drivers and vehicles used with the identity of drivers and vehicles that come after ordered by consumers, is the responsibility of online transportation companies as providers of online transportation service applications in organizing electronic systems.
