Abstract:

“Tujuan penelitian ini adalah untuk mengetahui penerapan perlindungan hukum atas konsumen mengenai makanan dan minuman yang sudah kadaluarsa sesuai dengan Undang-Undang Perlindungan Konsumen No. 8 Tahun 1999 serta memahami kedudukan BPOM dalam mengawasi makanan dan minuman yang sudah kadaluarsa merupakan tujuan dari penulisan jurnal ini. Metode penulisan penelitan jurnal ini mengginakan menggunakan metode penelitian normatif karena berlandaskan peraturan perundang-undangan dan doktrin, dengan menelaah dari sisi aturan hukum yang ada dan keterkaitannya dengan kasus-kasus yang telah terjadi sebelumnya. Hasil dan kesimpulan dari penulisan penelitian ini adalah bahwa dengan penyebaran makanan dan minuman yang telah kadaluarsa, produsen yang bersangkutan tidak menaati aturan-aturan yang terkandung dalam Undang-undang Perlindungan Konsumen sehingga diperlukannya lembaga penunjang seperti BPOM sebagai penindaklanjutan dan pengawasan terhadap makanan dan minuman yang tersebar di masyarakat agar dapat dikendalikannya produk konsumsi yang telah kadaluarsa agar tidak terus merugikan konsumen. This writing research method used in this journal is the normative research method because it is based on statutory regulations and doctrine, by examining the existing legal rules and their relationship with cases that have occurred before. The results and conclusions of the writing of this study are that with the distribution of expired food and beverages, the producers concerned do not comply with the rules contained in the Consumer Protection Law so that supporting institutions such as BPOM are needed as a follow-up and supervision of distributed food and beverages in society, therefore, that expired consumer products can be controlled so as not to continue to harm consumers.
