Abstract:

“Artikel ini bertujuan untuk mengetahui pengaturan tentang eksploitasi terhadap waktu kerja para pekerja serta untuk mengetahui bentuk perlindungan hukum akan para pekerja mengalami eksploitasi waktu kerja pada industri Fast Fashion. Artikel ini merupakan jenis penelitian hukum normatif dengan pendekatan yang digunakan adalah pendekatan perundang-undangan (statute approach) dan pendekatan konsep (conceptual approach). Hasil studi menunjukkan bahwa undang-undang ketenagakerjaan maupun Undang-Undang Cipta Kerja tidak secara khusus mengatur mengenai eksploitasi terhadap pekerja. Namun dalam pasal 77 Undang-Undang Ketenagakerjaan mengatur mengenai Waktu Kerja Pekerja dan Pasal 81 angka 22 ayat (2) Undang-Undang Cipta Kerja mengatur upah kerja lembur yang dimana pasal-pasal tersebut dapat dikatakan sebagai bentuk peraturan eksploitasi terhadap pekerja. Mengenai bentuk perlindungan hukum terhadap pekerja dengan adanya eksploitasi tersebut diatur dalam pasal 81 angka 65 ayat (1) dan pasal 81 angka 66 ayat (1) UU Cipta Kerja. Bentuk perlindungan yang diberikan yakni sanksi pidana kurungan dan sanksi pidana denda. Serta bentuk perlindungan lainnya melalui pengawasan ketenagakerjaan sesuai Peraturan Presiden No. 21 Tahun 2010 tentang Pengawasan Ketenagakerjaan seperti melalui Pengawasan; bimbingan; serta pendidikan dan pelatihan dalam rangka pembinaan hubungan industrial antara pengusaha dan pekerja agar terciptanya hubungan harmonis tanpa adanya perbuatan eksploitasi. The results of writing this study show that labor law also omnibus law do not specifically regulate the exploitaton of workes. However, in article 77 of the Labour Law regulates working hours and article 81 point 22 paragraph (2) of the Omnibus Law regulates overtime pay, which these articles could be said to be form worker exploitation regulations. Regarding the form of legal protection for workers with exploitation regulated in article 81point 65 paragraph (1) and article 81 point 66 paragraph (1) of the Omnibus Law with the form of protection provided in the form of imprisonment dan fines. Other forms of protection through labor inspection appropriate with Presidential Regulation about Labor Inspection such as through Supervision; guidance; as well as education and training in the framework of fostering industrial realtions between employers and workers to create hamonious realations without exploitation.
