Abstract:

“Penelitian jurnal ini bertujuan untuk mengkaji hak-hak korban Tindak Pidana Narkotika dalam Proses Perlindungan Hukum serta menganalisis kendala oleh penegak hukum dalam memberikan perlindungan hukum bagi pelaku dan korban Tindak Pidana Narkotika. Metode penelitian yang digunakan yaitu metode penelitian empiris dengan pendekatan perundang-undangan, konseptual dan pendekatan fakta. Studi ini bersifat deskriptif yakni yang didapatkan dari sumber data yang terdiri dari data primer, sekunder dan tersier. Metode pengumpulan data dengan studi kepustakaan dan studi lapangan (wawancara) kemudian data dianalisis secara kualitatif. Hasil studi ini menunjukkan bahwa ditinjau dari hak yang diberikan kepada korban tindak pidana narkotika dari aparat penegak hukum adalah dengan melakukan pembinaan dan pencegahan, dan dalam proses perlindungan hukum untuk menjalankan proses rehabilitasi dan kendala yang dihadapi oleh penegak hukum dalam memberikan perlindungan hukum bagi pelaku dan korban tindak pidana narkotika sudah tidak terdapat kendala dikarenakan jumlah personil yang dimiliki oleh Ditresnarkoba Polda Bali mencukupi serta peran dari masyarakat dinilai sudah bagus dalam bekerja sama dengan melapor tindak pidana narkotika dan masyarakat mempunyai kepedulian serta berperan aktif dari adanya tindak pidana Narkotika. Kata Kunci: Perlindungan Hukum, Pelaku, Korban, Tindak Pidana Narkotika. ABSTRACT This study aims to examine the rights of victims of the Narcotics Crime in the Legal Protection Process and to analyze the obstacles by law enforcers in providing legal protection for the perpetrators and victims of the Narcotics Crime. The research method used is an empirical research method with a statutory approach, conceptual and factual approaches. This study is descriptive in nature, which is obtained from data sources consisting of primary, secondary and tertiary data. Methods of data collection using literature study and field studies (interviews) then the data were analyzed qualitatively. The results of this study indicate that in terms of the rights granted to victims of narcotics crimes by law enforcement officials, guidance and prevention are carried out, and in the process of legal protection to carry out the rehabilitation process and the obstacles faced by law enforcers in providing legal protection for perpetrators and victims. Narcotics crime has no obstacles because the number of personnel owned by the Bali Regional Police is sufficient and the role of the community is considered to have been good in working together to report narcotics crime and the community has a concern and plays an active role in the existence of the Narcotics crime.
