Abstract:

“ABSTRAK Penelitian ini bertujuan untuk untuk menganalisa dan mengetahui bagaimana prosedur penyidikan dalam pengadilan HAM, khususnya prosedur penanganan ketidaklengkapan hasil penyidikan pelanggaran HAM berat yang oleh jaksa agung yang bertugas sebagai penyidik kepada jaksa agung yang bertugas sebagai penuntut umum. Pada karya ilmiah ini menggunakan metode “penelitian normatif”. Dalam penelitian kali ini menunjukkan bahwa mengenai prosedur pengembalian berkas perkara oleh penuntut umum kepada penyidik mengikuti proses prosedur dalam melengkapi hasil penyidikan dengan memperhatikan Pasal 22 ayat (1) sampai dengan Pasal 22 ayat (5) UU Pengadilan HAM dan diperjelas dalam pengaturan mengenai proses pengembalian berkas penyidikan yang terdapat dalam KUHAP sebagai lex generalis dari UU Pengadilan HAM. Kata Kunci : Pengadilan Hak Asasi Manusia, Penyidik, Penyidikan ABSTRACT This research aims to analyse and determine how the procedures for the investigation of human rights courts, especially the procedure of the incompleteness of violations of heavy human rights abuses by the Attorney general who served as an investigator to the attorney general who served as a public prosecutor. In this scientific work uses the method “normative Research”. In this study shows that the procedure of file return by the prosecutor to the investigator follow the procedure in completing the investigation in article 22 paragraph (1) up to article 22 sentence (5) of the law of the Human rights court and is defined in the arrangement on the process of refund of the investigation contained in the criminal code as Lex generalist of the human rights court act.
