Abstract:

“Makalah ini bertujuan untuk mengetahui pertimbangan hukum bagi Hakim dalam menjatuhkan putusan pemidanaan sehingga menjatuhkan pidana terhadap terdakwa berdasarkan Pasal 81 ayat (2) UU RI No.23 Tahun 2002 tentang Perlindungan Anak dan bukan Pasal 287 ayat (1) KUHP. Makalah ini menggunakan metode penelitian yuridis normatif dan pendekatan perbandingan terhadap undang-undang.”
