Abstract:

“Tujuan penulisan studi ini untuk mengkaji mengenai pengaturan hukum, kedudukan hukum dan tantangan dalam mewujudkan hak politik penyandang disabilitas dalam mengikuti pemilihan umum dikaji dari hukum positif Indonesia. Studi ini menggunakan metode penelitian hukum normatif ialah jenis penelitian yang diterapkan untuk menyusun tulisan ini. Hasil studi menunjukan semua warga negara Indonesia, termasuk mereka yang memiliki keterbatasan fisik, berhak untuk memilih dalam pemilu. Penyandang disabilitas selalu menjadi pertimbangan dalam pembuatan peraturan teknis penyelenggara pemilu. Artinya, seluruh warga negara yang memakai haknya harus dilakukan secara bebas (tanpa gangguan), tanpa intimidasi (tidak ada paksaan dari luar), dan bebas dari diskriminasi (tanpa larangan atau pembatasan di luar Peraturan Perundang-undangan). Hak dalam memilih serta hak untuk dipilih ialah jaminan perlindungan dan pengakuan atas hak-hak yang dijamin oleh UUD 1945. Kata Kunci: Hak Politik, Pemilihan Umum, distabilitas. ABSTRACT The purpose of writing this study is to examine legal regulations, legal position and challenges in realizing the political rights of persons with disabilities in participating in general elections studied from Indonesian positive law. This study uses normative legal research methods, which is the type of research applied to prepare this article. The study results show that all Indonesian citizens, including those with physical limitations, have the right to vote in elections. Persons with disabilities are always taken into consideration in making technical regulations for election organizers. This means that all citizens who exercise their rights must do so freely (without interference), without intimidation (no external coercion), and free from discrimination (without prohibitions or restrictions outside of statutory regulations). The right to vote and the right to be elected is a guarantee of protection and recognition of the rights guaranteed by the 1945 Constitution.
