Abstract:

“ABSTRAK Penulisan ini merupakan bentuk penelitian yang dilakukan guna mengetahui perlindungan hukum terhadap saksi dan korban terutama saksi pelaku dalam tindak pidana Pungutan Liar di Indonesia. Penulisan ini dilakukan dengan menggunakan metode penelitian yuridis normatif dengan memperhatikan peraturan perundang-undangan dan disesuaikan oleh buku, artikel serta doktrin-doktrin yang berkembang. Hasil penelitian menunjukan bahwa adanya ketidakpastian hukum akibat pengaturan yang ada hanya memberikan perlindungan terhadap saksi dan korban dari tindak pidana tertentu dan terorganisir, sedangkan praktik pungutan liar dapat masuk dalam berbagai kateori tindak pidana yang sama merugikannya. Hasil penelitian juga menunjukan bahwa perlindungan terhadap saksi pelaku secara normatif hanya diberikan kepada saksi pelaku yang merupakan Justice Collabortor sedangkan terdapat saksi pelaku berupa Saksi Mahkota yang dapat membutuhkan perlindungan serupa. Kata Kunci: Perlindungan, Saksi, Pelaku, Pungutan Liar ABSTRACT The scientific purpose of this research is to investigate the legal protection for witnesses and victims, particularly witnesses who are also perpetrators, in cases of Illegal Levies in Indonesia. This study employs a normative juridical research method, taking into account legal regulations and integrating insights from books, articles, and evolving doctrines. The research findings reveal that legal uncertainty arises due to the existing regulations, offering protection only for witnesses and victims of specific, organized criminal acts, while Illegal Levies practices can fall into various categories of equally detrimental criminal acts. Additionally, the research findings demonstrate that normative protection for witnesses who are also perpetrators is exclusively provided to Justice Collaborators, while there are witness-perpetrators, such as Crown Witnesses, who may require similar protection Key Words: Protection, Witnesses, Perpetrators, Illegal Levies.”
