Abstract:
“Kajian ini bertujuan untuk melakukan kajian mendalam terhadap prosedur pembuktian dalam persidangan pidana, khususnya terkait pemeriksaan terhadap saksi-saksi yang tidak mengikuti KUHAP. Dengan fokus pada bidang peraturan perundang-undangan, penulis menggunakan metode penelitian empiris di bidang hukum. Hasil studi menunjukkan bahwa terdapat ketidaksesuaian antara das sollen dan das sein mengenai pelaksanaan pemeriksaan saksi di persidangan khsususnya pada perkara pidana di Indonesia. Pada pasal 160 ayat (1) a UndangUndang Nomor 8 Tahun 1981 mengatur secara jelas mengenai prosedur pemeriksaan saksi, yaitu para saksi dipanggil dan diperiksa satu per satu di ruang sidang namun dalam kasus yang penulis kaji, dalam agenda pembuktiannya pemeriksaan saksi dilakukan secara bersamaan sehingga hal ini berpotensi mempengaruhi keterangan saksi sehingga keterangan yang didapat dalam alat bukti ini menjadi kurang meyakinkan. Kata Kunci: Hukum Acara Pidana, Pemeriksaan Saksi, Das Sollen, Das Sein. ABSTRACT This study plans to conduct an in-depth examination of the evidentiary procedure in criminal trials, especially in regard to the questioning of witnesses who do not follow Indonesia’s Criminal Procedure Code. With a focus on legislation, the author employs empirical research techniques in the legal field. The results of the study show that there is a discrepancy between das sollen and das sein regarding the conduct of witness examinations in special trials in criminal cases in Indonesia. Article 160 paragraph (1) a of Law Number 8 of 1981 clearly regulates the procedure for examining witnesses, namely witnesses are called and examined one by one in the courtroom but in the case that the author is reviewing, in the evidentiary agenda the examination of witnesses is carried out simultaneously so that is has the potential to influence witness statements so that the information obtained in this evidence becomes less convicing.
