Abstract:

“Penelitian ini memiliki tujuan utama adalah memberikan pengetahuan bagaimana bentuk pertanggungjawaban pidana oleh anak yang menjadi pecandu narkotika. Metode yuridis normatif serta pendekatan perundang-undangan berupa buku buku hukum adalah metode penelitian yang dipakai dalam riset ini. Hasil penelitian memperlihatkan anak yang menjadi pecandu narkotika dihukum pidana penjara dan rehabilitasi sesuai dengan UU No.35/2009 Tentang Narkotika dan menggunakan UU No.11/2012 Tentang SPPA. Dalam menjatuhkan putusannya hakim wajib melindungi hak-hak anak serta mempertimbangkan masa depan anak tersebut. Faktor-faktor yang menyebabkan anak menjadi pecandu narkotika terdiri dari 3 faktor yaitu pribadi, lingkungan dan delik narkotika lainnya. Kata Kunci : Anak, Narkotika, Pertanggungjawaban Pidana. The normative juridical method and the statutory approach in the form of law books are the research methods used to support this study. The results showed that children who become narcotics addicts supposed to be given punishment in the form of imprisonment and rehabilitation in accordance with Law No.35/2009 about Narcotics and using Law No.11/2012 about SPPA. In making its decision, the judge must protect the child’s right and consider the child’s future. Factors that makes children becoming drug hooked consist of 3 factors, namely individual factors, the environment and other narcotics crimes. Keywords: Children, Narcotics, Criminal Liability.”
