Abstract:

“Tujuan studi ini adalah untuk mengkaji aspek hukum pemotongan upah pekerja oleh perusahaan yang mengalami kerugian akibat COVID-19 dan menelaah langkah hukum yang dapat ditempuh oleh pekerja yang mengalami pemotongan upah oleh perusahaan. Penelitian ini menggunakan penelitian hukum normatif dengan pendekatan peraturan perundang-undangan dan pendekatan konsep. Berdasarkan penelitian yang dilakukan terhadap permasalahan hukum yang diteliti oleh penulis, berkaitan dengan pemotongan upah pekerja yang dilakukan secara sepihak oleh perusahaan ternyata tidak berdasarkan hukum sehingga dapat menimbulkan perselisihan hak. Selanjutnya berkaitan dengan langkah hukum yang dapat ditempuh oleh pekerja yang mengalami kedaan tersebut dapat melakukan perundingan bipartite dan mediasi sebagai upaya penyelesaian sebelum melakukan gugatan pada Pengadilan Hubungan Industrial. The purpose of this study is to examine the legal aspects of deducting employee wages by companies that have suffered losses due to COVID-19 and to examine the legal steps that can be taken by employees who experience wage cuts by the company. This research uses normative legal research with a statutory and conceptual approach. Based on the research conducted on the legal issues examined by the author, regarding employee wage cuts that were carried out unilaterally by the company, it was not based on law so that it could lead to rights disputes. Furthermore, with regard to legal steps that can be taken by employees who experience this situation, they can conduct bipartite negotiations.”
