Abstract:

“ABSTRAK Penelitian ini ditujukan dalam menganalisis mengenai pengaturan sanksi kebiri kimiawi kepada pelaku kekerasan seksual pada anak-anak sesuai HAM serta implikasi hukum pada pengaturan sanksi kebiri kimiawi kepada pelaku kekerasan seksual pada anak. Penelitian ini mempergunakan pendekatan hukum normatif serta menerapkan dua jenis pendekatan, yaitu pendekatan konseptual dan pendekatan perundang-undangan. Pada penelitian ini, dapat diketahui anatra lain (1) Pengaturan ketentuan UU No. 17/2016 tentang Penetapan Peraturan Pemerintah pengganti Undang-Undang No. 1/2016 tentang perubahan kedua UU No. 23/2002 tentang perlindungan anak menjadi UU dan PP No. 70/2020 tentang tata cara pelaksanaan kebiri kimiawi, pemasangan alat pendeteksi elektronik, rehabilitasi, dan pengumuman identitas pelaku kekerasan seksual pada anak, merupakan pelanggaran terhadap prinsip Hak Asasi Manusia dikarenakan dapat digolongkan sebagai sanksi yang berbenturan terhadap UU No. 39/1999 tentang Hak Asasi Manusia serta UUD NRI Tahun 1945. Penyiksaan ini ditimbulkan oleh dampak dari zat anti–androgen terhadap kesehatan fisik dan psikis seseorang. (2) Implikasi Hukum dari pengaturan sanksi kebiri kimiawi yang berbenturan dengan UU No.39/1999 tentang Hak Asasi Manusia serta UUD NRI Tahun 1945 yaitu adanya pertentangan dengan hierarki sistem hukum perundang–undangan serta ketidakpastian hukum di Indonesia. Jika terdapatnya suatu ketidakpastian hukum, maka keadilan dan kemanfaatan akan sulit tercapai pada suatu peraturan perundang-undangan. Kata Kunci: Kepastian Hukum, Hak Asasi Manusia, Kekerasan Seksual, Kebiri Kimiawi ABSTRACT This research is aimed to analyze the regulation of chemical castration sanctions against perpetrators of sexual violence against children in accordance with human rights and the legal implications of regulating chemical castration sanctions against perpetrators of sexual violence against children. This study uses normative legal research by applying two types of approaches, conceptual approach and statutory approach. In this research, it can be seen that (1) the provisions of Law No. 17/2016 concerning Stipulation of Government Regulation in lieu of Law No. 1/2016 regarding the second amendment to Law No. 23/2002 concerning child protection became law and PP No. 70/2020 concerning procedures for carrying out chemical castration, installing electronic detection devices, rehabilitation, and announcing the identity of perpetrators of sexual violence against children, are a violation of the principles of human rights because it can be classified as a sanction that conflicts with Law No. 39/1999 concerning Human Rights and the 1945 Constitution of the Republic of Indonesia. This torture is caused by the impact of anti-androgen substances on a person’s physical and psychological health. (2) The legal implications of setting chemical castration sanctions that conflict with Law No. 39/1999 concerning Human Rights and the 1945 Constitution of the Republic of Indonesia, namely the existence of conflicts with the hierarchy of the statutory legal system and legal uncertainty in Indonesia. If there is a legal uncertainty, then justice and expediency will be difficult to achieve in a statutory regulation. Keywords: Legal certainty, Human rights, Sexual violence, Chemical castration”
