URGENSI PEMBENTUKAN ATURAN TINDAKAN TRADING IN INFLUENCE TERHADAP PEMBERANTASAN TINDAK PIDANA KORUPSI DI INDONESIA

Abstract:
“ABSTRAK Penelitian ini bertujuan untuk memberikan pemahaman mengenai bentuk-bentuk pola tindakan trading in influence yang menimbulkan perbedaan dengan jenis-jenis korupsi lainnya serta dapat menganalisis terkait urgensi pembentukan aturan tindakan trading in influence terhadap pemberantasan tindak pidana korupsi di Indonesia. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, permasalahan kasus dan konseptual. Hasil penelitian menunjukkan bahwa trading in influence sebagai tindak pidana korupsi tidak hanya dilakukan oleh pejabat publik melainkan dapat dilakukan oleh orang biasa. Secara umum trading in influence dilakukan melalui tiga bentuk pola yakni: vertikal, vertikal dengan broker dan horizontal. Bentuk-bentuk pola tersebut menyebabkan perbedaan mendasar dengan jenis-jenis tindak pidana korupsi yang ada di Indonesia. Adanya perbedaan, menyebabkan kekosongan norma, dikarenakan keterbatasan aturan yang menyebut trading in influence sebagai tindak pidana korupsi. kekosongan norma tersebut akan menyulitkan aparat penegak hukum dalam mengungkap kasus yang terindikasi adanya tindakan trading in influence. Dilihat dari situasi yang ditimbulkan oleh tindakan trading in influence, perumusan ketentuannya menjadi suatu urgensi dalam hukum positif Indonesia. Nantinya, didalam merumuskan aturan trading in influence perlu mengadopsi ketentuan yang ada didalam United Nations Convention Against Corruption (UNCAC) agar perubahan pasal ataupun pembaharuan undang-undang terkait tindak pidana korupsi dapat menciptakan suatu kepastian hukum, keadilan hukum serta kemanfaatan hukum. Kata Kunci: Trading In Influence, Tindak Pidana Korupsi, Pembaharuan aturan. The method that used in this research is normative legal research with statutory, case and conceptual approach. Research results show that trading in influence as a criminal act of corruption can not only be carried out by public officials but it is also possible to be done by ordinary people. In general, trading in influence is carried out through three patterns, namely: vertical, vertical with a broker and horizontal. These forms of patterns lead to different types of corruption that exist in Indonesia. The existence of differences causes a void in norms, due to limited regulations which state trading in influence as an act of corruption. The void of norms, will make it difficult for law enforcement officials to uncover cases that indicate trading in influence. Judging from the situation caused by the act of trading in influence, the formulation of its provisions has become an urgency in Indonesia positive law. Later, regarding the formulation of trading in influence regulations, it is necessary to adopt the provisions contained in the United Nations Convention Against Corruption (UNCAC) so that amending articles or reformed laws related to criminal acts of corruption can create legal certainty, legal justice and legal benefits.
