Abstract:

“ABSTRAK Penulisan artikel ini menjelaskan tentang masalah ketenagakerjaan yang muncul karena dampak Pandemi Covid-19. Hingga mengakibatkan pemutusan hubungan kerja yang dilakukan perusahaan terhadap tenaga kerja. Oleh sebab itu suatu perlindungan hukum sangat diperlukan, agar menjamin kehidupan para pekerja yanggterkena PHK dalam masa pandemi. Penelitian ini merujuk pada penelitian normatif. Dimana metode penelitian secara normatif menggunakan pendekatan norma hukum serta perundang-undangan yang mengatur tentang ketenagakerjaan. Dalam hasil penelitian ini menunjukan bahwa Pemutusan Hubungan Kerja (PHK) akan membawa dampak buruk bagi para perkerja karena hilangnya suatu pekerjaan dan juga membawa dampak akan meningkatnya tingkat pengangguran maupun kemiskinan di Indonesia. Bentuk dari perlindungan hukum akibat adanya pemutusan hubungan kerja telah diatur lebih lanjut dalam Undang-Undang No. 13 Tahun 2003 Mengenai Ketenagakerjaan. Selain itu pemerintah juga menerbitkan produk hukum yang menjamin hak bagi para pekerja. Therefore, a legal protection is very necessary, in order to ensure the lives of workers who have been laid off during the pandemic. This research refers to normative research. Where the normative research method uses the approach of legal norms and legislation that regulates employment. The results of this study indicate that Termination of Employment (PHK) will have a negative impact on workers due to the loss of a job and will also have an impact on increasing unemployment and poverty rates in Indonesia. The form of legal protection due to termination of employment has been further regulated in Law no. 13 of 2003 concerning Manpower. In addition, the government also issued a legal product that guarantees the rights of workers. Key Words: covid-19, termination of employment, legal protection.”
