Abstract:

“ABSTRAK Studi ini bertujuan untuk menganalisis eksistensi dari Lembaga Alternatif Penyelesaian Sengketa dalam penyelesaian sengketa perbankan non-litigasi dan memahami kesesuaian dengan ketentuan penyelesaian sengketa berdasarkan peraturan perundang-undangan yang ada. Metode yang digunakan dalam penulisan ini menggunakan metode yuridis normatif berdasarkan pendekatan perundang-undangan (The Statute Approach), melalui studi literatur, studi dokumen dan analisis peraturan terkait Lembaga Alternatif Penyelesaian Sengketa Sektor Jasa Keuangan. Hasil studi menunjukan bahwasanya berdasarkan “POJK Nomor 61/POJK.07/2020”, urgensi pembentukan Lembaga Alternatif Penyelesaian Sengketa ialah untuk terlaksananya penyelesaian sengketa yang cepat, efisien, dan memberikan keuntungan kepada kedua belah pihak berdasarkan prinsip-prinsip Lembaga Alternatif Penyelesaian Sengketa. Sesuai dengan urgensi tersebut maka penyelesaian sengketa di luar pengadilan (alternative dispute resolution) merupakan proses yang sering dilakukan dalam penyelesaian sengketa perbankan. Kata Kunci : Sektor Jasa Keuangan, Sengketa Perbankan, Alternatif Penyelesaian Sengketa ABSTRACT This study aims to analyze the existence of alternative dispute resolution institution in resolving banking dispute through non-litigation method and understanding the alignment of the settlement regulation according to the primary legal materials. The method used in this paper is normative juridical through literature study, documents study referring to the statute approach. The results of the study show that according to the “Financial Services Authority Regulation no. 61/POJK.07/2020”, fast, efficient and win-win solution dispute resolution as the urgency of alternative dispute resolution institution existence. In compliance with this urgency, alternative dispute resolution is a common legal action taken in banking dispute resolution.
