Abstract:

“ABSTRAK Penelitian ini bertujuan untuk mengetahui bentuk-bentuk wanprestasi yang dilakukan pelaku usaha rumah penitipan hewan terhadap pemilik hewan selaku konsumen dan juga terkait dengan pertanggungjawaban yang diberikan oleh pelaku usaha rumah penitipan hewan yang dalam hal pelayanannya mengakibatkan suatu kerugian bagi pihak pemilik hewan selaku konsumen dan juga hewan peliharaan yang dititipkan. Penelitian ini dibuat menggunakan metode penelitian hukum normatif yang dalam pembuatannya menggunakan pendekatan secara perundang-undangan dan pendekatan secara fakta. Hasil penelitian menunjukkan bahwa bentuk-bentuk wanprestasi yang dilakukan oleh pelaku usaha jasa penitipan hewan yang menimbulkan kerugian bagi pengguna jasa penitipan hewan yaitu kemungkinan kesalahan pengelola rumah penitipan hewan, keadaan memaksa (overmacht) dan force majeure. Selain itu, pencantuman klausula eksonerasi pada perjanjian penitipan hewan batal demi hukum sehingga sesuai pasal 19 ayat (1) UUPK, apabila pelaku usaha wanprestasi maka dirinya wajib bertanggungjawab dengan memberi penggantian kerugian kepada pemilik hewan selaku konsumen.
