Abstract:

“ABSTRAK Tujuan yang ingin dicapai oleh penulis dalam artikel ini ialah untuk mengetahui dan memahami bagaimanakah bentuk perlindungan hukum, keabsahan dan upaya yang dapat ditempuh, oleh masyarakat khususnya kepada para pekerja yang dirumahkan berujung kepada PHK akibat adanya pandemi covid-19. Metode penelitian yang digunakan yaitu penelitian hukum normatif, dengan menggunakan pendekatan pada peraturan perundangan-undangan, dianalisis secara kualitatif dengan teknik-teknik penalaran dan argumentasi hukum dalam bentuk uraian naratif. Hasil penelitian menunjukkan bahwa bentuk perlindungan hukum terhadap pekerja yang dirumahkan berujung PHK adalah dengan memberikan kartu prakerja, Subsidi Gaji atau upah bagi perkerja atau buruh, insentif untuk korban PHK, WFH. Pemutusan hubungan kerja yang dilakukan oleh para pengusaha kepada pekerja di masa pandemi Covid-19 dengan alasan force majeur ialah tidak sah, apabila dilakukan oleh perusahaan yang tidak tutup secara permanen, upaya hukum yang dapat dilakukan oleh para pekerja jika belum mendapatkan haknya dapat dilakukan sesuai dengan ketentuan pada Pasal 151 ayat (3) dan (4) UU Cipta kerja. The research methods used in this journal are normative, using approaches to legislation, analysis, and argumentative. The results of the study in this journal are a form of legal protection for workers who are laid off to the point of layoffs is to provide pre-employment cards, salary subsidies or wages for workers or workers, incentives for victims of layoffs, WFH. Termination of employment carried out by employers to workers during the Covid-19 pandemic because force Majeure is invalid, if done by companies that are not permanently closed, legal efforts that can be made by workers if they have not obtained their rights can be done under the provisions of Article 151 paragraph (3) and (4) of the Copyright Law.
