Abstract:

“ABSTRAK Tujuan daripada studi ini adalah untuk mengkaji pengaturan investasi saham berbasis online dan mendalami bagaimana legalitas dari investasi saham berbasis online tersebut berdasarkan hukum indonesia. Metode penulis gunakan adalah metode normatif melalui cara deskriptif pendekatan konseptual serta peraturan perundang-undangan. Hasil dari studi ini menunjukan bahwa untuk pengaturan terhadap investasi saham berbasis online belum memiliki regulasi peraturan ataupun perlindungan hukum yang pasti, tetapi pengaturan terhadap saham ditemukan dalam Undang-Undang No. 40 Tahun 2007 tentang Perseroan Terbatas(UU PT), untuk legalitas investasi saham berbasis online terdapat pada Pasal 2 POJK No.24/POJK.04/2014, untuk legalitas dari Perusahaan Sekuritas diatur dalam POJK No. 20/POJK.04/2016. The method used is a normative method with a descriptive way through a conceptual approach and legislation. The results of the study show that online-based stock investment arrangements do not yet have definite arrangements, but arrangements for shares can be found in Law no. 40 of 2007 concerning Limited Liability Companies, the legality of online-based stock investments is contained in Article 2 of POJK No.24/POJK.04/2014, for the legality of Securities Companies it is regulated in PJOK No. 20/PJOK.04/2016.
