Abstract:

“ABSTRAK Tujuan dari penulisan jurnal ini adalah untuk memahami dan mengetahui bagaimana pengaturan terhadap hak-hak konsumen sebagai pelanggan provider Wi-Fi terhadap wanprestasi dari pihak provider dan mengetahui bentuk perlindungan hukum terkait konsumen yang merasa dirugikan oleh provider Wi-Fi. Metode penelitian yang digunakan dalam penulisan ini yaitu metode penelitian normative. Perlindungan hukum terhadap konsumen telah tertuang pada “Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen”, dimana dalam penulisan ini akan membahas perihal wanprestasi yang sering terjadi dari pihak provider Wi-Fi terkait ketidaksesuaian kecepatan internet yang ditawarkan dan disaat penggunaan layanan sehingga merugikan pihak konsumen. Walaupun sudah tertuang dalam “pasal 4 Undang-Undang Nomor 8 Tahun 1999 yang mengatur tentang hak konsumen serta dalam pasal 7 Undang-Undang Nomor 8 Tahun 1999 yang mengatur tentang kewajiban pelaku usaha”, masih kurangnya kepastian hukum bagi hak-hak konsumen yang harus dilindungi dalam halnya sebagai konsumen pelanggan provider Wi-Fi. Maka dari itu, agar pihak konsumen mendapatkan apa yang menjadi haknya, diperlukannya kepastian hukum yang mengatur dan melindungi agar berjalannya asas dari perlindungan konsumen sendiri yang tertuang dalam “Pasal 2 Undang-Undang Nomor 8 Tahun 1999.” Kata kunci: Perlindungan hukum, konsumen, provider Wi-Fi. ABSTRACT The purpose of writing this journal is to understand and find out how to regulate the rights of consumers as customers of the Wi-Fi provider against default from the provider and to find out the form of legal protection related to consumers who feel aggrieved by the Wi-Fi provider. The research method used in this paper is normative. Legal protection for consumers has been stated in “Law No. 8 of 1999 concerning Consumer Protection”, which in this paper will discuss defaults that often occur from the Wi-Fi provider regarding the incompatibility of the internet speed offered and when using the service to the detriment of the consumer. Although it has been stated in “Article 4 of Law Number 8 of 1999 which regulates consumer rights and in Article 7 of Law Number 8 of 1999 which regulates the obligations of business actors”, there is still a lack of legal certainty for consumer rights which must be protected in this case. as a consumer of a Wi-Fi provider customer. Therefore, for consumers to get what they are entitled to, there is a need for legal certainty that regulates and protects so that the principle of consumer protection itself is contained in “Article 2 of Law Number 8 of 1999”.
