Abstract:

“ABSTRAK Adapun tujuan dalam penulisan artikel ini yaitu untuk menganalisa pengaturan mengenai pelaksanaan tindak pidana aborsi yang dilaksanakan oleh anak di bawah umur di Indonesia, dan juga bentuk perlindungan khusus yang diberi kepada anak di bawah umur yang melakukan tindak pidana tersebut, yang sekaligus juga merupakan seorang korban dari tindak pidana perkosaan. Dalam penulisan artikel ini memakai metode penelitian hukum normative, dengan melalukan pendekatan terhadap perundang-undangan dan juga kasus. Teknik pengumpulan bahan hukum dalam penulisan artikel ini menggunakan teknik kepustakaan, kemudian teknik analisisnya dilakukan teknik analisis deskriptif kualitatif. Adapun temuan dari penulisan artikel ini adalah tidak terdapat aturan yang secara khusus mengatur mengenai tindakan aborsi yang dilakukan oleh anak di bawah umur. Namun, Pasal 346 Kitab Undang-Undang Hukum Pidana (KUHP) dan Pasal 75 Undang-Undang Kesehatan dapat menjadi dasar hukum dalam pelaksanaannya. Adapun tindak pidana aborsi yang dilakukan oleh anak di bawah umur akibat dari ia merupakan seorang korban dari tindak pidana perkosaan, menurut Pasal 75 ayat (2) huruf b Undang-Undang Kesehatan diberikan sebuah pengecualian terhadap pelaksanaan aborsi dengan kriteria tertentu, salah satunya adalah bagi korban perkosaan, asalkan hal tersebut dapat dibuktikan terdapat terjadinya indikasi perkosaan sebagaimana diatur di dalam Pasal 34 Kesehatan Reproduksi. Dalam kasus seperti ini pula, anak yang sebagai korban berhak untuk mendapatkan perlindungan hukum sebagaimana diatur dalam Pasal 133 Undang-Undang Kesehatan, Pasal 89-90 Undang-Undang Sistem Peradilan Pidana Anak, dan Pasal 69A Undang-Undang Perlindungan Anak. As for the crime of abortion committed by a minor as a result of being a victim of a crime of rape, according to Article 75 paragraph (2) letter b of the Health Law, an exception is given to the implementation of abortion with certain criteria, one of which is for victims of rape, provided that it can be proven that there is an indication of rape as regulated in Article 34 of Reproductive Health. In cases like this too, children who are victims are entitled to legal protection as stipulated in Article 133 of the Health Law, Articles 89-90 of the SPPA Law, and Article 69A of the Child Protection Law.
