Abstract:

“ABSTRAK Tujuan dari penulisan jurnal ini yaitu untuk mengetahui peraturan perundang-undangan mengenai hukuman mati dan eutanasia di dalam hukum positif Indonesia serta membandingkan antara hukuman mati dengan eutanasia dalam sudut pandang Hak Asasi Manusia. Dalam penulisannya menggunakan metode penelitian hukum normatif dengan teknik deskriptif melalui pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukan bahwa hukuman mati dalam peraturan perundang-undangan bukan merupakan pelanggaran hak untuk hidup dengan adanya Putusan Mahkamah Kontistusi, sedangkan eutanasia masih merupakan pelanggaran terhadap hak untuk hidup pasien. Walaupun eutanasia yang dalam peraturan perundang-undangan di Indonesia belum mengatur secara jelas mengenai hal tersebut, tetapi untuk dokter dan keluarga pasien dapat dikenakan Pasal 344, Pasal 340, Pasal 304 jo Pasal 306 ayat (2) jika melakukan eutanasia aktif dan pasif. Diharapkan sebuah aturan yang jelas mengenai eutanasia yang dapat menjadi acuan tentang tindakan medis yang mana saja yang merupakan eutanasia. Kata Kunci: Eutanasia, Hak Asasi Manusia, Hukuman Mati ABSTRACT The purpose of writing this journal are to find out the laws and regulations regarding the death penalty and eutanasia in Indonesian positive law and to compare the death penalty with eutanasia from human rights perspective. This journal is written using normative legal research methods with descriptive techniques through a statutory approach and a conceptual approach. Based on the research, the laws and regulations show that the death penalty is not a violation of the right to life with the Constitutional Court Decision, while eutanasia is still a violation of the patient’s right to life. Although eutanasia, which is in the laws and regulations in Indonesia, does not clearly regulate this matter, but doctors and patients’ families can be subject to Article 344, Article 340, Article 304 in conjunction with Article 306 paragraph (2) if active and passive eutanasia is carried out. So it is hoped that a clear rule regarding eutanasia can be a reference for which medical actions are eutanasia. Key Words: Euthanasia, Human Rights, Death Penalty”
