Abstract:

“ABSTRAK Penelitian ini bertujuan untuk mengkaji pengaturan perampasan aset korporasi hasil tindak pidana illegal fishing di Indonesia serta urgensi pengaturan perampasan aset korporasi dalam mencegah terjadinya kerugian negara akibat dari dilakukannya illegal fishing. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan (statue approach) dan pendekatan konseptual (conceptual approach). Hasil penelitian menunjukkan bahwa sistem hukum di Indonesia tidak mengatur mekanisme perampasan aset korporasi hasil tindak pidana illegal fishing di Indonesia. Pengaturan perampasan aset korporasi ini sangat penting mengingat kerugian yang ditimbulkan baik secara ekonomi maupun lingkungan dari tindak pidana illegal fishing sangat besar. Pemerintah perlu segera membentuk produk hukum terkait mekanisme perampasan aset korporasi hasil tindak pidana illegal fishingguna memberika kepastian, kemanfaatan dan keadilan hukum bagi masyarakat dan Negara. Kata Kunci : Illegal Fishing, Perampasan Aset, Korporasi ABSTRACT This research aim to investigate the regulation of confiscation of corporate asets resulting from illegal fishingin Indonesia and urgency of regulating asset forfeiture of corporate to prevent state losses due to illegal fishing. In this study, the researcher uses normative research method with conceptual approach. The result of this study indicate that law system in Indonesia do not set confiscation asets of result criminal act of illegal fishingin Indonesia. The adjustment of confiscation of corporates asets is essential due to the disadvantage and damaging economic and the environment in Indonesia. The government need to create law products due to confiscation of corporate asets resulting from illegal fishingin order to provide conviction, advantages, and legal justice to every community and state.
