Abstract:
“ABSTRAK Penelitian ini bertujuan untuk mengkaji pengaturan mengenai pemberontakan serta akibat hukum bagi warga Negara yang melibatkan diri sebagai pemberontak. Tulisan dibuat dengan memakai metode penelitian hukum normatif dengan berfokus pada peraturan perundang-undangan. Hasil penelitian menunjukan bahwa pengaturan pemberontakan dalam sudut pandang hukum humaniter termasuk ke dalam konflik bersenjata semu yaitu konflik Negara dengan non Negara melalui Pasal 1 Ayat (4) Protokol tambahan I bahwa konflik dengan senjata disamakan dengan konflik bersenjata dalam hukum internasional. Akibat hukum penduduk Indonesia yang tergabung dalam kelompok radikal seperti ISIS tidak menyebabkan kewarganegaraanya dicabut karena termasuk ke dalam tindak pidana terorisme dengan ancaman hukuman pidana penjara seumur hidup. Writings are made using normative legal research methods by focusing on legislation. The results showed that the arrangement of rebellion in the viewpoint of humanitarian law belongs to the pseudo-armed conflict that is the conflict of the State with non-State through Article 1 Paragraph (4) Additional Protocol I that conflict with weapons is equated with armed conflict in international law. As a result, Indonesian citizens who belong to radical groups such as ISIS do not cause their citizenship to be revoked because they are included in terrorism crimes with the threat of life imprisonment.
