Abstract:

“Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap konsumen dalam pembelian asset kripto di Indonesia dan mengetahui upaya hukum yang dapat ditempuh oleh konsumen apabila terdapat kerugian akibat pembelian asset kripto melalui transaksi elektronik. Adapun pendekatan yang dipergunakan pada penulisan ini adalah pendekatan perundang-undangan, pendekatan konsep dan kasus serta teknik analisis secara deskriptif. Hasil dari penelitian ini adalah perlindungan hukum terhadap konsumen dalam pembelian asset kripto pada transaksi elektronik belum diatur secara khusus melainkan tersebar dalam beberapa peraturan seperti UU Perlindungan Konsumen, UU ITE maupun Perbappebti Nomor 8 Tahun 2021. Penguatan perlindungan konsumen dibutuhkan dengan membentuk bursa kripto sebagai amanat dari Perbappebti Nomor 8 Tahun 2021. Upaya hukum yang dapat ditempuh konsumen apabila terdapat kerugian pembelian asset kripto melalui transaksi elektronik yakni dengan penyelesaian sengketa secara litigasi maupun non litigasi. This study aims to determine the legal protection of consumers in purchasing crypto assets in Indonesia and find out the legal remedies that can be taken by consumers if there are losses due to the purchase of crypto assets through electronic transactions. The approach used in this writing is a statutory approach, a concept and case approach and descriptive analysis techniques. Result of this research is regarding to legal protection for consumers in purchasing crypto assets in electronic transactions has not been specifically regulated but is spread in several regulations such as the Consumer Protection Law, ITE Law and Perbappebti Number 8 of 2021. Strengthening consumer protection is needed by forming a crypto exchange as a mandate from Perbappebti Number 8 of 2021. Legal remedies that can be taken by consumers if there is a loss in the purchase of crypto assets through electronic transactions are by resolving disputes in litigation and non-litigation.”
