Abstract:

“Artikel ini bertujuan untuk mengetahui penyebab terhambatnya sertipikasi tanah di Kota Denpasar. Meskipun Kementerian ART/BPN telah meluncurkan Program Prioritas Nasional berupa percepatan Pendaftaran Tanah Sistematik Lengkap (PTSL) yang dilakukan secara serentak di seluruh Indonesia. Yang juga telah diatur dalam Instruksi Presiden (Inpres) Nomor 2 Tahun 2018. Namun, sekitar 16% dari total keseluruhan luas tanah di Kota Denpasar masih belum tersertipikasi. Artikel ini menggunakan metode penelitian yuridis empiris dengan pendekatan perundang-undangan dan fakta. Hasil dari penelitian ditemukan bahwa terdapat dua penyebab terhambatnya sertipikasi tanah di Kota Denpasar, yaitu tanah yang dimiliki oleh Desa Adat dikarenakan tanah tersebut milik desa yang tidak dapat diwakilkan oleh siapa pun termasuk Kepala Desa yang masa jabatannya hanya 6 (enam) tahun, dan tanah yang dimiliki oleh Puri dikarenakan pihak Puri tidak mau mensertipikatkan tanahnya lantaran di dalam Puri terdapat banyak Keluarga yang tidak diketahui siapa pemilik tanah yang sebenarnya, sehingga pihak Puri khawatir apabila tanahnya disertipikasi maka akan terdapat perselisihan antar keluarga yang tinggal di dalam Puri tersebut. This article aims to determine the causes of delays in land certification in Denpasar City. Although the Ministry of ART/BPN has launched a National Priority Program in the form of accelerating Complete Systematic Land Registration (CSLR) which is carried out simultaneously throughout Indonesia. Which has also been regulated in Presidential Instruction (Inpres) Number 2 Year 2018. However, around 16% of the total land area in Denpasar City is still not certified. This article uses an empirical juridical research method with a statutory and factual approach. The results of the study found that there were two causes of delays in land certification in Denpasar City, namely land owned by the Traditional Village because the land belonged to the village which could not be represented by anyone including the village head whose term of office was only six years, and land owned by Castle because the castle does not want to certify the land because in the castle there are many families who do not know who the real land owners are, so the castle is worried that if the land is certified there will be disputes between families living in the castle.”
