Abstract:
“Penelitian ini bertujuan untuk mengetahui Perlindungan hukum konsumen dan pelaku usaha pada pembelian serta penjualan online melalui e-commerce cash-on-delivery. Metode penelitian yang dipergunakan merupakan metode penelitian hukum yurisidis normaif dengan menggunakan pendekatan peraturan perudang-undanganan yang berlaku saat ini terkait dengan penggunaan aturan-aturan yang diatur. Hasil penelitian Pelaku bisnis dan pembeli transaksi online dengan e-commerce seperti Tokopedia dan Shopee dalam sistem pembayaran Cash on delivery berhak atas perlindungan hukum jika salah satu pihak merasa dirugikan, seperti perlindungan hukum terhadap pelaku usaha jika konsumen tidak mau membayar barang pesanan melaui sistem Cash On Delivery. Konsumen menolak membayar barang pesanan kepada kurir menyebabkan munculnya wanprestasi karena konsumen telah melanggar empat ketentuan sahnya perjanjian seperti yang ada dalam KUHPER.Adanya salah satu pihak yang melakukan wanprestasi, maka penyelesaian Perselisihan antara pedagang dan konsumen dapat diselesaikan melalui peradilan/litigasi dan non litigasi/di luar pengadilan sesuai dengan keinginan dari para pihak. Perjanjian tentang bentuk dan besaran ganti rugi, dan/atau melakukan tindakan langsung agar tidak terulang kembali atau kerugian yang diderita konsumen tidak terulang kembali. This study aims to determine the legal protection of consumers and business actors in buying and selling online through e-commerce cash-on-delivery. The research method used is a normative juridical legal research method using the current statutory regulation approach related to the use of regulated rules. The results of the research Business people and buyers of online transactions with e-commerce such as Tokopedia and Shopee in the Cash on delivery payment system are entitled to legal protection if one party feels disadvantaged, such as legal protection for business actors if consumers do not want to pay for goods ordered through the system Cash On Delivery. Consumers refusing to pay for ordered goods to the courier cause defaults because the consumer has violated the four legal provisions of the agreement as contained in the KUHPER. If one of the parties commits a default, the settlement of disputes between traders and consumers can be resolved through court/litigation and non-litigation/in out of court according to the wishes of the parties. Agreement regarding the form and amount of compensation, and/or taking direct action so that it does not recur or the losses suffered by consumers are not repeated.”
