Abstract:

“Tujuan dari penulisan jurnal ilmiah ini, antara lain untuk mengetahui dan menganalisis mengenai pengaturan ruang terbuka hijau dikawasan perkotaan berdasarkan peraturan perundang-undangan di Indonesia, serta pengaturan perizinan terkait ruang terbuka hijau dilihat dari perspektif Undang- Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang dan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. Penelitian ini tergolong penelitian hukum normatif yang menggunakan pendekatan perundang-undangan dan pendekatan komparatif. Hasil studi menunjukkan pengaturan ruang terbuka hijau dikawasan perkotaan berdasarkan regulasi di Indonesia diatur dalam Undang- Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang dan Peraturan Menteri Dalam Negeri Nomor 1 Tahun 2007. Namun selanjutnya justru ditemui adanya perbedaaan antara Undang-Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang dan Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja terkait pengaturan perizinan terkait ruang terbuka hijau, yaitu Pasal 35 Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja terdapat sub-klausul dalam Pasal 35 Undang- Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang sebelumnya. Kata Kunci: Ruang Terbuka Hijau, Penataan Ruang, Regulasi ABSTRACT The purpose of writing this scientific journal, among others, is to find out and analyze the regulation of green open space in urban areas based on the laws and regulations in Indonesia, as well as licensing arrangements related to green open space seen from the perspective of Undang- Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang and Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja. This research is classified as a normative legal research that uses a statutory approach and a comparative approach. The results of the study show that the regulation of green open space in urban areas based on regulations in Indonesia is regulated in Undang- Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang and Peraturan Menteri Dalam Negeri Nomor 1 Tahun 2007. However, it was found that there were differences between Undang-Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang and Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja regarding licensing arrangements related to green open spaces, namely Article 35 of Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja, sub-clause in Article 35 of Pasal 35 Undang- Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang previously.
