Abstract:

“Artikel ini bertujuan untuk mengetahui dan menganalisis tentang pertanggungjawaban pidana anak yang melakukan tindak pidana penyalahgunaan narkotika. Artikel ini tergolong penelitian hukum normatif yang menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Berdasarkan hasil analisis, diketahui bahwa pertangungjawaban pidana anak yang menggunakan narkotika telah diatur dalam Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Berdasarkan peraturan a quo, maka anak tersebut akan direhabilitasi. Adapun rehabilitasi dalam hal ini terbagi atas 2 jenis, yaitu reahibiltasi medis dana rehabilitasi sosial. Upaya rehabilitasi terhadap anak yang menggunakan narkotika seyogyanya harus didukung oleh semua kalangan. Mengingat upaya rehabilitasi lebih beroirientasi pada tujuan pemulihan atas kondisi yang tidak inginkan dan juga dapat menjamin hak-hak anak. This article is classified as a normative legal research that uses a statutory approach and a conceptual approach. Based on the results of the analysis, it is known that the criminal responsibility of children who use narcotics has been regulated in Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Based on it, the child will be rehabilitated. The rehabilitation in this case is divided into 2 types, such as medical rehabilitation and social rehabilitation. Rehabilitation efforts for children who use narcotics should be supported by all groups. Considering that rehabilitation efforts are more oriented towards the goal of recovering from unwanted conditions and can also guarantee children’s rights.
