Abstract:

“Abstract This writing aims to find out and analyze the definition of the editorial “certain reasons” as regulated in Article 3 number 15 of the Notary Code of Ethics. The research study uses a normative juridical method with a statutory approach and a conceptual approach. The technique of collecting legal materials uses library research. The results of the study indicate that the definition of “certain reasons” is a reason that is permitted by law. If a violation of this article is committed, it will not affect the authenticity of the deed because the Notary is authorized to make the deed outside the office or outside his domicile while still in the area of ??office. If there is a violation caused by not fulfilling one of the requirements for the authenticity of the deed, it will result in the deed experiencing a decline or being degraded into a deed under the hand. Abstrak Penulisan ini bertujuan untuk mengetahui dan menganalisis tentang definisi dari redaksi “alasan-alasan tertentu” sebagaimana diatur di Pasal 3 angka 15 Kode Etik Notaris. Kajian penelitian menggunakan metode yuridis normatif dengan pendekatan perundang-undangan serta pendekatan konseptual. Teknik pengumpulan bahan hukum menggunakan studi kepustakaan. Hasil penelitian menunjukkan bahwa definisi mengenai “alasan-alasan tertentu” merupakan suatu alasan yang di perbolehkan oleh Undang-Undang. Jika pelanggaran terhadap pasal tersebut dilakukan, maka tidak serta mempengaruhi ke autentikkan akta dikarenakan Notaris berwenang membuat akta diluar kantor atau diluar tempat kedudukannya selama masih berada di wilayah jabatan. Apabila terjadi pelanggaran yang disebabkan karena tidak di penuhinya salah satu syarat otentisitas akta maka akan mengakibatkan akta mengalami kemerosotan atau terdegradasi menjadi akta dibawah tangan.”
