Abstract:

“ABSTRAK Penulisan penelitian ini adalah untuk mengetahui pengaturan hukum terhadap para pihak didalam pemberian jasa servis mesin kopi dan penyelesaian sengketa yang dialami oleh kedua belah pihak baik itu dari sisi pandang konsumen maupun penyedia jasa servis yang bersangkutan apabila terjadi sebuah kerusakan pada mesin kopi akibat kelalaian konsumen. Adapun jenis metode penelitian yang digunakan adalah menggunakan metode penelitian hukum empiris. Metode penelitian hukum empiris adalah metode penelitian yang yang mengkaji ketentuan Peraturan Perundang-Undangan serta melihat fakta-fakta yang terjadi dilapangan. Dalam hasil penelitian ini, permasalahan atau sengketa yang terjadi adalah kurang peka nya pihak pemilik toko kopi akan anjuran yang diberikan oleh teknisi mesin kopi atau dapat dikatakan adanya unsur kelalaian dari konsumen itu sendiri. Penyelesaian sengketa terdapat 2 cara yaitu penyelesaian sengketa di dalam pengadilan dan penyelesaian sengketa secara musyawarah. Pihak penyedia jasa servis mesin kopi Seren Works dalam kasus ini menggunakan penyelesaian sengketa secara musyawarah dikarenakan menurutnya penyelesaian secara musyawarah lebih menghemat waktu dan biaya dibandingkan penyelesaian di dalam pengadilan. The type of research method used is using empirical legal research methods. The empirical legal research method is a research method that examines the provisions of the legislation and looks at the facts that occur in the field. In this case, the problem or dispute that occurs is the lack of sensitivity of the coffee shop owner to the advice given by the coffee machine technician or it can be said that there is an element of negligence from the consumer himself. There are 2 ways to settle disputes, namely dispute resolution in court and dispute resolution by deliberation. The Seren Works coffee machine service provider in this case uses a deliberation dispute resolution because according to him, amicable settlement saves time and costs more than settlement in court.
