Abstract:
“Penelitian bertujuan untuk mengetahui konsep dan fungsi pengawasan ombudsman terkait maladministrasi pada sistem pelayanan publik. Penelitian ini mengacu pada peraturan perundangundangan yang berlaku baik di Indonesia. Penelitian ini dapat pula dikatakan sebagai penelitian kepustakaan. Dalam penelitian ini bahan hukum yang digunakan adalah pengumpulan dari sebuah studi kepustakaan. Proses pengumpulan bahan-bahan hukum yang digunakan dalam penelitian ini adalah telaah pustaka dengan cara melakukan penelusuran terhadap norma-norma yang mengatur tentang pengawasan Ombudsman. Dalam konsep pengawasan Ombudsman terkait permasalahan maladministrasi pada sistem pelayanan publik, Ombudsman wajib berpedoman para prinsip yang bersifat independen, tidak memihak kepada pihak manapun, tidak melakukan pungutan biaya, tidak melakukan diskriminasi pada pihak-pihak tertentu serta mempermudah dan mendengarkan segala bentuk pendapat atau keluhan dari pihak pelapor. Setelah mendapatkan pengaduan atau keluhan dari masyarakat, Ombudsman juga melakukan klarifikasi kepada pejabat publik yang telah dilaporkan. Hal ini bertujuan agar Ombudsman dapat melakukan analisis secara menyeluruh, mendalam, dan objektif. Melalui pemberdayaan masyarakat yang dilakukan oleh Ombudsman Republik Indonesia (ORI) dalam melakukan penyebarluasan informasi terkait dengan pemberian pemahaman kepada masyarakat diharapkan mampu menumbuhkan kesadaran masyarakat atas hak mereka untuk mendapatkan pelayanan yang terbaik dari penyelenggara pelayanan publik. This research refers to the prevailing laws and regulations in Indonesia. This research can also be said as library research. In this study, the legal materials used were collection from a literature study. The process of collecting legal materials used in this study is a literature review by means of tracing the norms that govern Ombudsman supervision. In the concept of Ombudsman supervision related to maladministration problems in the public service system, the Ombudsman must be guided by principles that are independent, impartial to any party, do not charge fees, do not discriminate against certain parties and facilitate and listen to all forms of opinions or complaints from the reporting party. After getting complaints or complaints from the public, the Ombudsman also clarifies what has been reported to public officials. It is intended that the Ombudsman can conduct a thorough, in-depth, and objective analysis. Through community empowerment carried out by the Ombudsman of the Republic of Indonesia (ORI) in disseminating information related to providing understanding to the community, it is hoped that it will be able to raise public awareness of their right to get the best service from public service providers.
