Abstract:

“Penelitian ini bertujuan untuk mengetahui dan menganalisis tentang implementasi penerapan protokol kesehatan pencegahan Covid-19 di Restoran Naughty Nuri’s dalam perspektif hukum perlindungan konsumen dan hambatan-hambatan yang ada dalam usaha penerapan protokol kesehatan tersebut. Penelitian ini merupakan penelitian hukum empiris, yaitu melihat hukum dalam artian nyata menggunakan fakta-fakta empiris dengan meneliti bekerjanya hukum di masyarakat melalui wawancara dan obervasi langsung ke lapangan. Pendekatan yang digunakan adalah yuridis sosiologis yaitu mengrekognisi hukum sebagai institusi sosial yang nyata dan fungsional dalam sistem kehidupan di masyarakat. Bahan hukum lainnya yang dipakai untuk mendukung penelitian ini adalah data sekunder yaitu bahan hukum primer dan sekunder. Hasil penelitian ini menemukan bahwa Naughty Nuri’s telah melakukan protokol kesehatan pencegahan Covid-19 bagi pemilik dan karyawan restoran sesuai Kepmenkes No. HK.01.07/Menkes/382/2020 sebagai usaha pemenuhan hak konsumen dan kewajiban pemilik usaha yang terdapat pada UU No. 8 Tahun 1999. Namun, terdapat hambatan dalam penerapan protokol kesehatan tersebut yang terdiri dari dua faktor yaitu faktor internal dan eksternal. Faktor internal yaitu masih ada karyawan yang tidak melaporkan kondisi kesehatan pada pimpinan. Selanjutnya ada faktor eksternal yaitu masih adanya konsumen yang tidak menggunakan masker dan menolak cek suhu tubuh. Kata Kunci : Protokol Kesehatan, Covid-19, Perlindungan Konsumen, Hak Konsumen ABSTRACT This study aims to analyze consumer protection through the Covid-19 health protocol at Naughty Nuri’s, one of Bali’s iconic restaurants and find obstacles in application of healthy protocol. This research is empirical legal research, which sees the law in a real sense using empirical facts by examining the work of law in society through interviews or direct observations in the field. The approach methodology is using sociological juridical, namely recognizing law as a real and functional social institution in the system of life in society. Additional legal materials are being used to support this research are primary and secondary legal materials. The results of this study found that Naughty Nuri’s has implemented a Covid-19 health protocol for restaurant owners and employees based on the Kepmenkes No. HK.01.07/Menkes/382/2020 as an effort to fulfill consumer rights and the obligations of business owners as contained in Law No. 8 of 1999. However, there are obstacles in the application of the health protocol which consist of two factors, such as internal and external factors. The main internal factors issue elaborates that there are employees who do not report health circumstances to the management. Furthermore, there are external factors, such as, there are still consumers who refuse to use masks and evade from body temperature screening. Although, in addition to business owners and restaurant workers whose require to uphold the health protocol, the Kepmenkes No.HK.01.07/Menkes/382/2020 also states that the health protocols must be carried out by customers at the restaurant.
